How St. Nicholas “gives” thirty-five million dollars to the officials of the Lysychan city military administration

On New Year’s holidays, on St. Nicholas Day, December 19, 2022, the Lysychansk City Military Administration (MBA) is publishing on its official website little-noticeable information about its intention to purchase real estate objects in communal ownership.

At the same time, on this day, Order No. 458 of December 19, 2022 is published. of the head of the Lysychansk City Military Administration Valery Shibiko “On the budget of the Lysychansk city-territorial community for 2023”, which provides for the allocation of funds for special fund expenses in the amount of 35 million hryvnias. In the explanatory note to the budget, signed by the Head of the Financial Department, Olga Sapegina, it is indicated: “Within the framework of the “Comprehensive target program for the resettlement of evacuated residents of the Lysychansk urban territorial community “Temporary housing” for 2022-2023″, budgetary allocations for the purchase of non-residential premises in the amount of 35,000,000 are provided UAH”.

The head of the Lysychanska City Military Administration, Valery Shibiko, violates the law by not publishing his orders! Which entails certain legal consequences of the illegitimacy of orders and certain actions of officials, and an administrative protocol with large fines from the Commissioner for Human Rights

The above-mentioned “Comprehensive target program for the resettlement of evacuated residents of the Lysychansk urban territorial community “Temporary housing” for 2022-2023″ on the basis of which the officials decided to wrangle the budget is not available on the website of the Lysychansk City Military Administration!

And only after reading the details of Order No. 57 dated November 29, 2022. of the head of the housing and communal services department Oleh Golub, you can see the “traces” (date and number) of this document: Order No. 253 dated 09/27/2022. the head of Lysychanska City Military Administration on approval of this program. Order No. 253 (like many others!!! – ed.) is not published on the website of the Lysychanska City Military Administration, which is a violation of Article 15 of the Law of Ukraine “On Access to Public Information” and is an indirect basis for applying to the court to consider it a sales contract real estate for migrants is invalid/illegitimate.

In addition, if citizens or law enforcement officers apply to the VRU Commissioner for Human Rights or to the court regarding the violation of the right to access to public information, the officials may be punished with significant fines.

(We remind you how we previously drew attention and wrote about the violation of the law by not publishing orders by the head of the Popasnian City Military Administration M. Khanatov, paragraph 10 of article 10 of the law “On the legal regime of martial law” informationally restricts the effect of the law “On access to public information“, i.e. gives grounds for “non-publication” only in two cases: 1) exempts officials from publishing draft normative legal acts “10 working days before the date of review”; 2) not to publish “the list and conditions of receiving services provided by these bodies, the forms and samples of documents, the rules for filling them out”).

“Stormy work” at the Holy Supper, as a way to draw less attention to the rickety budget of the Lysychan Territorial Community

On January 6, 2023, at the Holy Supper, Lysychansk officials will publish another piece of information: “The Lysychansk City Military Administration intends to purchase real estate objects into communal ownership.” Which during the New Year’s holidays, few people pay attention to from immigrants and potential sellers of real estate (see the screenshot below), which reduces competition from possible sellers of real estate. Officials also publish “CRITERIA THAT A REAL ESTATE OBJECT SHOULD MEET” and “LIST OF DOCUMENTS FOR THE SALE OF A REAL ESTATE OBJECT” as separate attachments on docs.google.com.

The silence of the “lambs” of the Lysychan city military administration about the purchase, or a “butt in the pocket” for the displaced people for UAH 35 million instead of a public invitation for residence

And then, against the background of loud distracting stories, how the resettled people were given “crumbs of bread”, deaf silence on the part of the officials (namely, in the person of the head of the Lysychanska MBA Valeriy Shibiko and his deputies and relevant heads of departments, departments) about the acquisition of the real estate object and the absence of an announcement/ inviting displaced people to live at this facility, which according to Clause 11 of the conditions of the announcement “must be adapted for comfortable, compact accommodation (living) of internally displaced persons.” The comprehensive target program for the resettlement of evacuated residents of the Lysychansk urban territorial community “Temporary housing” is designed for 2022-2023, and the year 2023 is already ending…

And only from the response to the information request published by a public activist, the society learns that “an object of immovable property – a building located at the address: str. Lisna, 1, p. Voynivka, Kirovohrad Region, LLC “Druzhba Children’s Rehabilitation and Recreation Facility“.

“Firefighters are looking”, everyone is looking – they can’t find it!

An interesting detail: on “Prozoro”, “Dozoro” and Ucontrol, the purchase and sale of such an expensive object for budget funds did not come to light in any way, it is impossible to find it on these resources! (Neither the editors nor other public activists could find this information). We will explain why they could not find it.

Strangely enough, only the TV channel “Pryamiy” (with a list of founders who are fans of P. Poroshenko) published an announcement about the intention to purchase real estate every day with Lysychanska MBA! (See the screenshot and on the Internet).

In addition, if you monitor budget expenditures for the 1st quarter and 1st half of 2023, you will not find such an amount (close to UAH 35 million) in the expenditure part of the special fund of the budget! According to the special fund, expenses with signs that we are looking for only “Measures for the prevention and liquidation of emergency situations and consequences of natural disasters” for the 1st quarter in the amount of 6.195 million UAH, and for the 1st half of the year in the amount of 21.549 million UAH. But Chief Valery Shibiko in his reply dated 05/12/2023 indicates that the object has been purchased, but at the same time he does not provide an extract from the state register of property rights to immovable property.

It turns out that the communal property of the Lysychansk municipal territory acquired a real estate object (Lisna St., 1, Voynivka Village, Kirovohrad Region) from the Druzhba Children’s Rehabilitation and Recreation Center LLC under one of the options of the following schemes: 1) on credit- which is not possible in our case; 2) with payment for the object in installments during 2023, because the funds for the purchase are pledged in the current year; 3) through some utility company under the statutory fund replenishment scheme? (Readers, suggest your options in the comments).

On the basis of which laws and regulations should the purchase of real estate be carried out by officials of the Lysychanska MBA? It is not specified in the purchase announcement

Why was such an expensive real estate purchase not lit up on electronic auctions (in Prozoro/Dozoro)? Because the Law “On Public Procurement” does not apply to the purchase of real estate. And in our case, there are no specific laws and regulations on the procedure for purchasing real estate with budget funds.

Officials in the ministries themselves do not know how to act in this matter. For example, in 2020, the VERCHNYOTORETSKA VILLAGE COUNCIL addressed the Ministry of Economy of Ukraine with a direct question: “Please tell me how to purchase housing for a large family, if the amount exceeds UAH 200,000?” But the ministry never gave a direct answer, only explaining that the law “On Public Procurement” does not apply to the purchase of real estate.

By taking the oath and signing the job description, every civil servant undertakes to abide by the Constitution and laws of Ukraine. Unlike citizens, who can do everything that is not prohibited by the law, officials are allowed to do only what the law allows.

In our case, officials of the Lysychanska MBA must act within the limits allowed by law. But neither in the first nor in the second announcement about the intention to purchase real estate is there any reference to the regulatory acts on the basis of which the purchase will be made. Which bears certain signs of violation.

The editors have an understanding of how Lysichan officials should act and what they did not do (signs of inaction) to cover their asses, but this is a separate issue beyond the scope of this publication. We just ask, where is the announcement about the results of the purchase and on what basis did they take place? Which is also a sign of violation.

The lack of publication of the economic justification of the value of the purchased/purchased real estate is the main sign of corruption

The main nail, as an argument about inaction, abuse and signs of corruption for law enforcement officers in this agreement, is the lack of publication of the economic justification of the value of the purchased/purchased real estate. Including for taxation purposes, the law requires such an assessment.

Manipulation of the names of legal entities and the signatory in the sales contract

From the copy of the last page of the contract for the purchase of the “object” available in the editorial office, it is difficult to make out who signed the document on the purchase of real estate from the Lysychanska MBA, but judging by the barely perceptible initials “O.V.” and the length of the surname is most likely: Olena Viktorivna Zyl.

Olena Viktorivna Zyl, according to Ucontrol data and according to the code 33537796 specified in the document, is the head of the Property Department (hereinafter ATTENTION! — allegedly no longer existing) of the Lysychansk city military-civilian administration, which is appointed “Temporarily to the position of head of the department for the period of martial law and suspension of labor agreement with Grechko T.O.”. That is, neither the head of the Lysychanska MBA V. Shibiko, nor the “eternal” head of property management T. Grechko escaped from signing the document with certain illegitimate signs and, as a consequence, criminal.

By the way, in the document, as the buyer, the “Lysychansk City Territorial Community” is indicated in the first place, which also legally exists, but why did the officials of the Lysychansk City MILITARY Administration manipulatively use the names of “allegedly non-existent/discontinued” legal entities and use budget funds on their behalf only to make assumptions and this is a matter for lawyers, and a job for law enforcement officers.

Does the hand wash the hand?

Among the participants/beneficiaries of the seller was the former village head of Voynivka, and local residents named us other officials

Yu. M. Rybak signed the contract from Druzhba Children’s Health and Recreation Center LLC, and Oleksandr Petrovych Tkach, registered in Zhytomyr, is the founder according to Ucontrol.

But as of September 26, 2022, among the participants/beneficiaries was Mykhaylenko Vasyl Ivanovich, who from 2006 to 2010 was the village head of the village. Voynivka, in 2010 he was elected a deputy of the Oleksandriysk City Council of the Kirovhorod Region from the Party of Regions, and now he is a self-nominated deputy of the Priyutiv Settlement Council.

Local residents also told us about other officials who were involved in the Oleksandriysk district of this pioneer camp “Druzhba” (see the video), but we did not find any documentary confirmation of these claims.

“Friendship”-gates or resonance in the Telegram channel and about the “sticking ears” of the first deputy head of the Lysychanska MBA Ruslan Sadovskyi

On August 10, 2023, the “Luhanshchyna Operational” Telegram channel publishes the following:

“In January 2023, the Lysychansk Community Center published information on its official website that it wants to purchase premises for the accommodation of internally displaced persons from Lysychansk. All this is part of the comprehensive target program “Temporary Housing” for 2022-2023, under this program, money is allocated for the purchase of housing for displaced people of Lysychansk. And so, in March 2023, the Lysychan OCA buys a former children’s camp in the village of Voynivka, Oleksandrii district, Kirovohrad region, for 34,559,850 hryvnias. Moreover, the cost of the buildings directly, according to the OCA response to the request of Lysychan activist Anatoly Ryzhkov, is 562,937 hryvnias. And then where did the millions go if this is the cost??

What did you buy there? And they bought three 2-story barracks, corridor type, with 4 bathrooms for the entire barrack and no showers. These barracks do not have heating systems, 1 of the barracks is in a state of disrepair, as is the cinema building!!!! Which is located on the same square. In all these premises, before the acquisition by Lysychanska VCA, military personnel were housed, and the camp itself has not been working or being repaired since 2019. That is, dilapidated buildings were bought for almost 1 million US dollars. In the “hell on the horns”, moreover, the barracks continue to rot, and the displaced persons from Lysychansk continue to rent apartments with their own funds… now the territory of the former camp “Druzhba” is closed, and no one has access to it. Although it is difficult to get there, even if you want to. Because there is almost no hard road surface in those places.

It is interesting that this camp was initially sold for 12 million hryvnias.

But when Lysychansk VCA became interested in him, his price increased to almost 35 million.

And in all of this, the ears of the deputy head of the Ukrainian Central Bank Ruslan Sadovsky, who has not seen Lysychansk even in his dreams, like all the other deputies in the Lysychansk Central Bank, stick out.”

Why did “Luhanshchyna operative” pay attention to Sadovsky’s question to the authors of the Telegram channel. We would like to draw your attention to the fact that the first deputy chief of the Lysychan city military administration, Ruslan Mykolayovych Sadovskyi, is probably not an official, but some kind of James Bond, is he working for Budanov or is he a wanted criminal? The Lysychansk community and the residents of the Luhansk region did not see or hear official Ruslan Sadovsky at all. There is no photo of him on the website of the Lysychansk MBA, and he does not promote himself on the official Facebook page, unlike his chief Valery Shibiko and his colleague, deputy chief Oksana Voloshina, which we already drew attention to in the publication: How the salary funds of the Lysychansk city military administration differ in 2022/2023 from Rubizhanska and Severodonetsk MBA.

On Facebook, we found a closed profile of “Olexandr Sadovskyi”, possibly our “deputy” with corresponding features (Obukhov, Kyiv) to his biography and his boss (see screenshot).

If this is the same Sadovsky, then he is the hero of many scandalous journalistic investigations, and as “Our Money” reported, Ruslan Sadovsky in the sixth convocation of the Rada was an assistant to Elbrus Tedeyev’s People’s Deputy from the Party of Regions in the Verkhovna Rada and previously had the surname GRYZA and had a joint business with his brother People’s Deputy from the “Renaissance” party, Yuriy Khomutynnyk.

Idle and blind policemen and prosecutors

On September 2, 2023, police chiefs (or rather, pseudo-certified cops?) from the Main Directorate of the National Police in the Kirovohrad region responded in a letter to the appeal of citizen Anatoliy Ryzhkov to the Luhansk Regional Prosecutor’s Office: “In the course of considering the circumstances that may indicate the commission of a criminal offense , was not found, and therefore the grounds for entering the information contained in it into the Unified Register of Pretrial Investigations were not established.” And the supervisory body, the prosecutor’s office (to whom the citizen appealed) does not see inaction and abuse in such a response of the police GU of the NP of Kirovohrad region and in the machinations of the officials of Lysychanska MBA.

The police officers themselves write in their answer (how they recorded the offense with their own hands!): “during the inspection, it was established that at this time on the territory of the specified object in one building there are people with their families who are carrying out cosmetic repairs of another building. Along with this, the territory has a well and a drainage system in working condition.” However, according to the “CRITERIA TO WHICH A REAL ESTATE OBJECT SHOULD MEET” published by the Lysychansk MBA, the following requirements are established: » item 2 Real estate objects that are considered for acquisition as communal property of the Lysychansk Urban Territorial Community must be 100% ready for construction. p.11 The object of immovable property must be adapted for comfortable, compact accommodation (living) of internally displaced persons. p. 5 The real estate object must be connected to the electricity supply, gas supply, water supply and drainage networks.

And the fact that, as we wrote above, in the explanatory note to the budget, signed by the head of the financial department, Olga Sapegina, budget funds in the amount of UAH 35 million are allocated for the purchase of NON-RESIDENTIAL PREMISES, which are precisely the premises of the pioneer camp for children to stay there only in the summer! Is this not a violation? (Society still does not know which premises are purchased “residential” or “non-residential”. And if they are residential and 100% ready for operation according to the Purchase Criteria, then why are there no announcements inviting resettled people to live there?).

Readers, do you see an offense in the fact that the announced criteria for the purchase of the object are not fulfilled during the purchase? ZARAZ.INFO journalists are sure that the majority will say “YES”! And the court said “YES” (see below). And the police and prosecutors have already said – “NO”!

The court ordered to enter into the Unified Register of Pretrial Investigations information about the commission of a criminal offense related to the purchase by Lysychanska MBA of the pioneer camp “Druzhba” in the village of Voynivka of the Kirovohrad region

In the Unified State Register of Court Decisions, we find that on September 15, 2023, the investigative judge of the Leninsky District Court of Kirovohrad (Kropyvnytskyi) PERSON_1, after considering the complaint of PERSON_3 in case No. 405/6165/23, on the inaction of the officials of the National Security Service in the Kirovohrad region, which consists in not providing information about a criminal offense to the Unified Register of Pre-Trial Investigations after receiving a statement or notification about a criminal offense dated August 1, 2023 issues a Resolution in which it decides:

“The complaint of PERSON_3 against the inactivity of the officials of the State Police in Kirovohrad region, which consists in not entering information about a criminal offense into the Unified Register of Pretrial Investigations after receiving a statement or notification about a criminal offense dated August 1, 2023, is to be satisfied.

Oblige an official of the National Police Service in Kirovohrad region, authorized to accept and register applications, notifications of criminal offenses, to enter into the Unified Register of Pretrial Investigations information on the statement of PERSON_3 dated 01.08.2023 about the commission of a criminal offense, within the time frame and in the manner specified in Art. 214 of the CPC of Ukraine“.

What did the displaced people of Lysychansk receive from the “Temporary Housing” program for 2022-2023?

After the stated facts, the question arises, what did the displaced persons from Lysychansk receive from the “Complex target program for the resettlement of evacuated residents of Lysychansk urban territorial community “Temporary housing” for 2022-2023” which was not published anywhere? Deryban by officials of budget funds in the amount of about 35 million hryvnias for the purchase of non-residential premises (according to the explanatory note to the budget)? And the conclusion of the police that “at the present time on the territory of the specified object in one building there are people with their families who are carrying out cosmetic repairs of another building”, despite the fact that the object should be 100% ready for exploitation by immigrants? Someone will say “Hole from a bagel“, and someone “Dula”. And the year 2023 is already ending.

What could be bought for 35 million hryvnias for the displaced people to really provide them with housing?

If the officials really wanted to provide housing for displaced people (especially vulnerable groups) as much as possible, they would, for example, look at websites selling real estate and ask how much apartments and houses cost in one or another region. And they calculated/compared the efficiency of purchasing “OBJECTS” with apartments and private houses.

In Alexandria, with a local population of ninety thousand, there are many private and apartment buildings. Having looked at the OLH website on October 12, we found many price offers for apartments and houses worth about $10,000 (equivalent to UAH 370,000) and cheaper (see screenshots).

That is, for 35 million hryvnias in this region (and not only), it was possible to buy about 100 apartments and houses (with a total area of at least 3,500 square meters), which would provide housing for at least 100 families or 300 people. And how many people will be able to live in the pioneer camp “Druzhba” on 1000 square meters. (according to the terms of purchase) provided that these are residential premises (and not premises for children’s temporary recreation in the summer)? According to our calculations, no more than 70(100) people in the conditions of not individual, but collective housing! Therefore, compare the difference in the efficiency of the use of budget funds.

Or they could rent apartments and houses, and in this case, at market prices, on average, you can rent 729 apartments/houses for one year, or 365 apartments/houses for two years, for 4,000 UAH per month.

The head of the Luhansk Regional State Administration, Artem Lysogor, wanted to control the funds after the deoccupation, but now he is unable to control the controlled Lysychansk MBA?

Based on our example of the inefficient use of budget funds by the officials of the Lysychansk MBA in the amount of UAH 35 million, the initiative of the head of the Luhansk Regional State Administration, Artem Lysohor, to form a “Transparency and Openness” working group at the Luhansk Regional State Administration to control the use of funds from the Fund for the Liquidation of the Consequences of Armed Aggression looks strange. » in order to control the funds that will come to the region after de-occupation. That is, they want to control the funds of international donors, but do not need budget funds? Why are the heads of the Luhansk Regional State Administration, Artem Lysohor, and the Severodonetsk District State Administration, Roma Vlasenko, not fulfilling their direct official duties (prescribed in the law) to control local military administrations under their control today? We took and visited the OBJECT-pioneer camp “Druzhba” in the village of Voynivka and arranged a “debriefing of flights” with officials of the Lysychansk MBA. Incompetent and inactive?

While the head of the Luhansk Regional State Administration, Artem Lysogor, dreams of controlling the funds “someday later” and does not want/afraid/inaction to control local administrations, journalists and volunteers are doing public control now and went to “Druzhba”
